1. Agreement to Terms

By accessing or using the Obvious mobile application ("App," "Service," or "Obvious"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

2.1 Age Requirement

• You must be at least 13 years old to use Obvious
• By creating an account, you confirm that you are 13 years or older
• If you are between 13 and 18, you confirm you have parental or guardian consent

2.2 Account Responsibility

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to accept responsibility for all activities under your account
• You must notify us immediately of any unauthorized use of your account

3. User Accounts

3.1 Account Creation

To use Obvious, you must create an account by providing:

• A valid email address
• A username (3-20 characters)
• A secure password

3.2 Account Termination

You may delete your account at any time using the "Delete Account" feature in the Profile screen. Upon deletion:

• All your votes will be permanently deleted
• Your streak statistics will be removed
• Your profile information will be erased
• This action cannot be undone

4. How Obvious Works

4.1 Daily Voting

• Each day, 3 new questions are posted
• You vote on what you think the majority will choose
• Votes are final and cannot be changed
• Results are revealed after midnight UTC

4.2 Streaks

• A streak is maintained by getting 2 out of 3 questions correct on consecutive days
• Streaks are calculated automatically by our system
• Missing a day or getting less than 2 correct breaks your streak
• We do not manually adjust streaks except in cases of technical errors

5. Acceptable Use Policy

You agree NOT to:

5.1 Prohibited Conduct

• Use offensive, inappropriate, or hateful usernames
• Harass, threaten, or intimidate other users
• Attempt to manipulate voting results or leaderboards
• Create multiple accounts to gain unfair advantages
• Use automated scripts, bots, or tools to interact with the App
• Reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Violate any applicable laws or regulations

5.2 Rate Limits

• You are limited to 5 vote attempts per minute
• Excessive requests may result in temporary or permanent account suspension

6. Intellectual Property

All content, features, and functionality of Obvious, including but not limited to text, graphics, logos, images, software code, algorithms, question content, and leaderboard functionality are protected by copyright, trademark, and other intellectual property laws.

6.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes. You may NOT copy, modify, distribute, create derivative works, or use the App for commercial purposes without our written permission.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free from viruses or harmful components
• Results or data will be accurate or reliable

7.1 Use at Your Own Risk

You use the App at your own risk. We are not responsible for:

• Loss of data or streaks due to technical issues
• Incorrect voting results due to system errors
• Downtime or service interruptions
• Compatibility issues with your device

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We will NOT be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or goodwill, service interruptions or data loss, or errors or omissions in content.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed $100 USD (currently $0 for a free app).

9. Modifications to the Service

We reserve the right to:

• Modify or discontinue any feature of the App
• Change how streaks or leaderboards are calculated
• Update the App's design or functionality
• Add or remove features without notice
• Suspend or terminate the Service at any time

10. Modifications to Terms

We may modify these Terms at any time by posting updated Terms in the App and updating the "Last Updated" date. For material changes, we will send you an email notification.

By continuing to use the App after changes are posted, you agree to the updated Terms. If you do not agree to the changes, you must stop using the App and delete your account.

11. Dispute Resolution

11.1 Informal Resolution

Before filing a legal claim, you agree to contact us at support@obvious.app to attempt to resolve the dispute informally. We will make a good-faith effort to resolve disputes amicably.
